Children from the First Marriage

My step-dad passed away, leaving several life insurance policies for my little brother and mom. His children from a previous marriage came into the picture during his illness. They had been gone for close to 30 years. Now they are demanding to see his will and feel they are entitled to some of the insurance benefits. This is not a very large estate. There is a will that list my mom and brother as beneficiaries; no trust. (An attorney told it is was not necessary because of the size of the estate) Do the children from marriage #1 have a leg to stand on?

In order for these children to be beneficiaries under your step father's estate, they will have to be named as beneficiaries under his Will. The life insurance policies name a specific beneficiary, so given this information they do not have a right to the policy(ies).
