Legal Question in Wills and Trusts in Arizona

my ex husbands will

In 2004 My ex husband passed away 4 months after our divorce was finalized. His will had me as beneficiary of an insurance policy but when he passed his childrens attorney says the insurace policy goes to the contingent beneficiaries which were his children because we were divorced and nothing was stated in the divorce decree that the insurance policy stays the same. When he passsed he never did change the insurance policy, I was still the beneficiary. Has his family scamed me or is this true that a divorce changes the insurance policy.

Re: my ex husbands will

It is true that the divorce takes you off as beneficiary, probably for just the circumstances that prevail in your case. Unless the divorce decree specifically addresses the policy, it is presumed that your ex-husband would have changed beneficiaries.
