Legal Question in Wills and Trusts in Arizona

will of estate into trust

My grandma had a will with beneficiary age of 25 years. The Executor on will put it into trust after Grandma deceased and ages have changed to the beneficiaries to 35 years now. Does this override Grandmas will and is this legal?

It is possible that it may override the trust, but you need to contact the attorney to review the documents and their provisions for an answer you can rely on.

Re: will of estate into trust

Sounds like someone made an error somewhere along the way. You should contact the trustee, get a copy of the trust documentation as well as the will.

Sounds like it might be worthwhile to have a consultation with an attorney to discuss your options.

Re: will of estate into trust

I do not believe the trustor's wishes can be changed by the trustee, but would have to see the trust and will. You can bring it to our office for a free, no obligation consultation arranged by calling 480.835.1500. It is not really possible to give a reliable opinion without seeing the documents. If this is an Arizona trust, you are welcome to show it to me.

Best regards,

James D. Jenkins
