Legal Question in Workers Comp in Arizona

workman's comp

I have an injury from Jan. 07 and as of yet have no diagnosis and only have 4 mos. left of WC at work. During this time I worked for a month helping in another area at work but not the job I was hired to do,all the while using my WC time. My concern is that with just 4 remaining months and no diagnosis as of yet, what can happen to me if within the last months the doctor wants to do surgery and I have no time left on the books. What are my options? I have been advised that I would lose my job but at this point I shouldn't be concerned or worried. I love my job and don't want to lose it but I am very concerned about my situation. I have worked throughout the injury and have complied with my employers therapists and doctors and would like to know if it's about time for a second opinion with an independant physician. I asked if the dr. doesn't want me going back to my position could I apply for a different position within the company. There response was only if I qualified for the position. I have been employed with them for seven years and feel I should get some consideration or kudos for the time worked while using my WC time. Thank you for looking over this and any advise you can provide.

Re: workman's comp

Under Arizona law, workers' compensation benefits can last a lifetime. There is no limit. You indicated that you are working still, so I presume that you are not running up against a limit, set by your employer, for how long you can be off work. I must conclude, therefore, that somebody has misinformed you about a time limit for medical care in workers' compensation. That simply does not exist. Please feel free to call my office for a free, no-obligation phone consultation, so I can ask you some questions to make sure that my opinion is correct.
