Legal Question in Bankruptcy in Arkansas

How Ex-Spouse Bankruptcy Effects New Marriage

My husband's ex-wife filed for bankruptcy after they were divorced, but since we have been married within the last year and a half. They leased a car together that my was in my husband's possession. Before we returned the car (one month earlier than the lease ending date) we were told by the finance company that they could not send us invoices nor hold us liable for that vehicle (March 2002) Since then (January 2003-first communication was in October), they have billed us for various fees related to returning the leased vehicle and my question is can they hold my husband responsible for that debt? Especially after they told us on many occaisions that we were not responsible for it and didn't owe anything. Of course we could not get that in writing-that is when they told us that they could not invoice us or send us any correspondence on this, but since then did send a letter as a result of a so-called request to set up a payment plan. We didn't take responsibility for this nor request a payment plan. We ask them to send us something in writing. Can he be held responsible and what should we do about this finance company?

What financial stipulations were outlined in your husband's Divorce Decree? If he was financially responsible for the debt, it doesn't matter what any employee tells you.
