Legal Question in Criminal Law in Arkansas

A citation received in a National Park in Arkansas for possession of a controlled substance (marijuana) - was written incorrectly.

1. the date was written as the following day.

2. the first name was written as the middle name instead of the first name.

What is the best way/approach to get this dismissed... on a technicality?

What are the chances of getting it dismissed?

Can it aggravate a judge and make it worse?

I would put your chances of getting it dismissed on these grounds somewhere between slim and none -- and considerably closer to none. Minor errors like this do not matter.

The citation is supposed to give you notice of what you are accused of doing and when, but it doesn't have to be perfect. You obviously know that the citation was issued to you, so the error in your name hasn't denied you notice. You also clearly know when this happened since you realize the date on the citation is wrong.

You should get a lawyer and let her figure out the best way to defend you against the charges.

Good luck.
