child custody jurisdition

my sister married in arkansas, had her son in arkansas but moved to texas when her son was 3 and left her husband after a year in texas. after a year and $15,000 later there is still no divorce the tempory orders are expired and there is no future court date set. her lawyer wants to wait until child is in school to push for court date, but in the mean time she has child in counseling because he vomits at even the mention of going to his dads. her husband has proven he will continue to fight her over every little thing..so my question is can jurisdiction be changed to arkansas?

If the original action was instituted in Texas, then Texas will continue to have exclusive jurisdiction over the matter as long as one parent is still there.
