i'm in australia my husband is in the US with my daughter wants a divorce and taken my daughter from me ,can i file for divorce and custody here in australia if his there?

You can apply for a divorce in Australia if you are an Australian citizen. Whether you can apply for custody here will depend on a number of things including whether you consented to him taking your daughter to the USA and how long they have been gone. You should seek legal advice as soon as possible.
