Legal Question in Disability Law in California

santa clara county unfair treatment

a few years ago a freind of mine in california moved into her mothers house to take care of her mum as she is suffering from altziners. then santa clara county took control over her mothers estate , i do not know why.my freid is disabled as she has had a stroke which has left her with diminished movement in her left arm and both legs. the county made my freinds respoceble for hermothers health care knowing she her self was disabled. now they have taken her mother into care, and will not tell my friend where she is .and are now saying my freind must pay rent to live in her own mothers house ,the house which will be hers should her mother die.is it legal for them to do so and to expect a disabled woman thtat is in a wheel chair much of the time to take care of an elderly woman with altzimers who needs . alot of attention it seems as though they set her up to fail as they have know of my friends medical condition from the outset .

I assume that there are significant facts you are unaware of, as the County is not going to hide your friend's mother. She needs to find out if she can become her conservator. If her mother does not have a Will or a Living Trust, she should find out from her mother's physicians if she is still lucid enough to make such documents. There probably is some disabled rights group in the area; they should be contacted.

Normally, rent should be paid for living in another person's house, but an exception i smade for a child living with there parents.. But I also assume the agreement made with her mother is that in return for your friend taking care of her mother she could live there rent free
