Legal Question in Appeals and Writs in California

small claims appeal

I won a small claim action. There was no cross complaint. The defendant has appealed. What am I exposed to if the smaill claim judgment is reversed and the defendant wins?

Re: small claims appeal

If you lose, then you will not get paid on the judgment and may be hit with costs, which may include attorney's fees if the opposition brings an attorney. Contact me directly.

Mr. Hoffman has already answered; you should not post 4 times. You did not say how much you were awarded or your case was worth. An attorney will charge you at least $200 per hour; with everything involved you will have to pay at least $800. See if the ohter side is open to a reasonable settlement; some cash in hand is worth avoiding the trouble of a trial de novo in which the udge may misudnerstand the evidence and decide for the other side, and then you have to be able to collect from them.
