Legal Question in Bankruptcy in California

Backruptcy Filing

I filed a Chapter 13 in Dec. 2007. I filed for an emergency order to file without going through the credit counseling first. That was denied and the filing dismissed. Can I re-file now, going through the counseling and have it be effective? also, If I were to file a 7 first can it convert to a 13?

Re: Backruptcy Filing

If your bankruptcy case was dismissed due to the failure to file the requisite credit-counseling, you have to file a motion to reopen the case. There is a fee for this, and I will be glad to prepare the motion. David Burkenroad
