Legal Question in Bankruptcy in California

Do I have to go to a court hearing??

A couple of years ago my husband and I had a truck repossesed. As of current they are garinishing my paycheck because my husband (we are seperated)doesn't have a job. I just filed bankruptcy because it was going to be too much of a financial burden. Prior to filing I was adviced to file a claim of exemption, so I did. There is a hearing for the opposition to the claim of exemption. Do I have to still attend although I have filed?

It probably wouldn't hurt. You should inform the court of your bankruptcy filing so that any money held by the Sheriff's Department might be returned to you. You should tell your bankruptcy attorney about the hearing and ask him for further advice. If you don't have an attorney, you should notify the Chapter 7 trustee in writing. You should also notify the Sheriff's Department in writing as well.
