i paid a lawyer for a b/k still has not filed 10mo

You haven't provided us with enough information -- such as whether you gave the lawyer everything the lawyer requires, whether there's been communication between you and the lawyer, whether there are issues (such as being financially qualified to file a Chapter 7) that need resolution before the BK is filed, etc. If you've done everything required, then you can send a certified, return receipt demand letter to the attorney demanding a refund of your money, and go elsewhere for legal assistance.

Perhaps your lawyer does not feel comfortable about filing your bankruptcy just yet and he/she is doing some bankruptcy planning.
