Legal Question in Bankruptcy in California

Pre-petition or Post-petition Priority

Dear Sir/Madam

My company sold goods to Mervyn's, which has now entered Chapter 7 liquidation. Most of the debts are post-petition trade credit for goods shipped. Are our debts given priority over pre-petition claims? Or visa versa?

Thank you for your help.

Re: Pre-petition or Post-petition Priority

You need to retain legal counsel. Chapter 11 creditor claim handling is far too complex to be resolved by virtue of this forum. Good luck.
