Legal Question in Business Law in California

Breach of contract, statute of limitations

I recently purchased two puppies (litter-mates). Two days after we brought them home, they were both very sick. Six days after we brought them home, puppy ''B'' died of Parvo. How long do I have to go back to the breeder for compensation? We have a substantial vet bill for the pups.

You need to examine the policies of the breeder. If there were no limitations in the exchange you should contact them and ask for reimbursement. If they refuse take it to Small Claims Court, or hire an attorney to send them a letter.

Re: Breach of contract, statute of limitations

The most important factor will be the terms of your agreement with the breeder.

If you entered into a written agreement then that agreement will govern unless this was an issue that was not addressed, wherein the industry standard would disctate what is customary.

You need to keep in mind that a Pet is not like any ordinary item, and rules regarding warranties may differ under such circumstances.

However, attempt to resolve it without legal intervention, and if that is useless you can have an attorney prepare correspondence and negotiate settlement on your behalf.

Good luck
