Legal Question in Business Law in California

is this

a complaint was filed with HR that an employee overheard a conversation with a group of people talking about another employee (spreading gossip is how HR stated) during lunch break. is it ok for the business to use what was heard during the lunch break give a warning to the offenders that spreading gossip in the office is not allowed. the group denied the allegations. i thought lunch time was our own time & we can talk about anything. does this make it right when the HR Manager was privy to the conversation as the HR Manager sat with the offending group & participated in the conversations & yet the allegations exclude the HR Manager?

Anything you do on company property is subject to company rules and discipline action. You have no 'privacy' rights there. You can lodge a complaint that the HR person should also be warned for his participation, if that is what really occurred.
