Legal Question in Business Law in California

evictions

i was served an eviction notice (30 days). there wasn't any reason stated on it. the name of my landlord wasn't mentioned on it. on the bottom of the notice there was a place to fill out for proof of service, this wasn't filled out. is this notice legal? what are my rights? can i be evicted just because they don't like me? i have a new owner and i have been in this location for 3 years.

Re: evictions

This is not a simple question, but I will give you some basics.

If you do not have a written lease for a longer term, you are probably a month to month tenant, which means that either you or the landlord can terminate the rental on one month's notice.

If you are in an area covered by rent control, you may be protected from such a termination without cause.

Finally, there are specific procedures that need to be followed to terminate your tenancy, and later to evict you. If these are not followed precisely you may be able to delay eviction.

I would advise against forcing eviction, because it can affect your ability to get another apartment.

Unless you are protected, you may be better off working out a deal with your new landlord. Feel free to contact me for more discussion.

Re: evictions

Do you have something beyond a month to month lease? If not, then they probably can evict.
