Legal Question in Business Law in California

legal contracts

I signed a contract for services to be rendered, however I have not received a copy of the contract signed by the service provider and it's has been over 30 days. Is this contract still legal and binding or am I able to withdraw my need for his services. He has started the work, but has not completed what he said he would in the time frame he stated.

Re: legal contracts

The fact that you failed to obtain a copy of the contract containing the other party's signature does not relieve you from your obligations under the contract. You should contact the other party and tell them that you no longer need their services, and that, based upon their failure to perform within the time stated in the contract, you are cancelling the contract. However, if the person has already started work, you will still be liable for whatever he/she has already done, and possibly for the entire contract price, depending upon what type of services you are talking about.
