Suspended Corporation

The property management company for my building in rent control Santa Monica goes by xxx, Inc. The building is owned by an individual (who is also the owner of the corporation) and the family trust.

The corporation is listed as suspended by the FTB since 2004 but continues to conduct business.

In regards to the suspended corporation I have tried to contact every agency imaginable to find out how the suspended corporation can continue to do business.

The Santa Monica City Attorneys office answered one of my emails and said they do not regulate this but they said they show it as a sole proprietorship and the owner should ''probably not'' be using the Inc with the name. However, the owner not only insists, she DEMANDS that the Inc. be included on correspondence and on our rent check.

She and her trust have tried to evict us from our garage (which they lost and are appealing) and seem to do a number of shady things which I would like to see stopped.

How can I find out if it is a soul proprietorship or a suspended corporation? Who do I contact if it is a suspended corporation?

I hope this was somewhat clear as it is very involved.

It's not clear what exactly you are trying to resolve here with calling out that the corporation is suspended. Does it really make a difference to you if you write "Inc." on the check? If your agreement calls for you to write a check to a specific person or entity then you are better off doing that. It is their problem if the corporation is suspended.
