Legal Question in Civil Rights Law in California

Have I been assaulted by the police?

I was driving 10:30 at night in the freeway, in Los Angeles County, going the speed limit, and had violated no law. All of a sudden I got pulled over by the police. He came by my window, and said '' what the F*** are you doing in your car?'' get out. So, he brought me out of the car, threw me on my car and hand cuffed me and put me in back of his car. I kept on asking him why he's doing this and he said that i should just shut up. So as i watched from the back of his car, he searched my entire car for a couple minutes. Then he came and brought me out of the police car. I ''cussed'' him out, and he said that if i didnt keep my mouth shut, he could hit me with his batton and no one would know what had happened to me. During this whole time, he didnt even ask to see my drivers license or registration. Then he just told me to leave. Could I possibly have any rights to sue the police department?

Re: Have I been assaulted by the police?

Sure, IF you could prove everything you say, which would require ID of the officer, witnesses to the events, etc. It is unlikely you will be able to do so, but if you have enough evidence, contact me to discuss.
