have a case in probate, and while in probate a person ,non family member went in my sons house and stole everything including vehicles and the carpet, I asked an attorney about this and he told me nothing can be done, tried to get the sheriff to make a report but they said it was a civil matter...I believe a crime was done and I need advise and help

You said it "he stole". To me, per your statement, a crime took place. Hence, a report must be taken by the local law enforcement.
