Legal Question in Civil Rights Law in California

if my tree scratch my neighbor's car, do we have to pay for it? We warn him weeks in advance to move his car which is under the tree. Although he was on vacay,we sent the landowner a letter telling them the tree is tilting and might crush the car but they did not do anything to the car that is under the tree.
