Legal Question in Technology Law in California

I'm building a software application which will provide a service based on the actual location of the user ( Location based service on Mobile phones). Service providers can register/bind their services to a given geographic location . (For example : a Restaurant owner can register his service to a particular geographic location where (S)he actually owns the restaurant ) But it is possible for some one, who actually does not own the 'Real estate' but can register the service for that geographic location. Are there any legal laws exists to prevent this ?

Not that I know of; and further, I'd say you should not even be concerned with ownership of the real estate. A restaurant, for example, will often lease its premises, and the actual owner may be thousands of miles away. If you want a quick check on ownership, the best resource would be county recorder or tax collector records, and in some states and counties this information is not available on-line.
