Legal Question in Technology Law in California

Cameras at work and being watch thru the internet

I work in a restaurant where there are cameras every where. The problem is that besides being watch 24 hours, being recorded where they can see everything, now the owner can watch what we are doing from his home, from the internet box that he install. Is that legal? Can he watch us from the internet?isn't that violating our privacy?

Re: Cameras at work and being watch thru the internet

By definition, your privacy can only be violated if you have a reasonable expectation of privacy in the first place. You can reasonably expect privacy in your home or in a private office or restroom, but in most parts of a restaurant you either won't be alone or can expect someone else to walk in at any time. Perhaps more importantly, the premises belong to your boss and not to you so he has a legitimate interest in monitoring what goes on there.

If your boss were at the restaurant I'm sure you would agree he could keep an eye on you. The fact that he is at home does not give you an expectation of privacy that you would not have had while he was around.

Please note that all I am saying is that your boss's actions are probably legal. I am not saying that they are reasonable or appropriate. Without more facts, I can't form an opinion on such matters -- and even if I could, it would be my personal judgment and not an opinion about the law.
