Legal Question in Technology Law in California

I am interested in the legalities of a creating a site that refers people to gaming sites for affiliate income.

I would not be hosting a gambling site, but rather an informational site. A visitor may them click on a banner advertisement from a gaming company that directs them to that gaming site. The visitor would make their own decision whether to place bets.

If the visitor opens an account and or loses money from the bet, I would receive a commission from the gaming site.

1) is this legal for a US citizen?

2) if not legal as a US citizen/resident, what if I restrict my visitors on to non-US based visitors.

Even if you were an out-and-out gambling site, a visitor would still "make their own decision" to bet or not.

Your risk here is less than that of the gaming sites themselves (other things being equal), but not non-existent. I think you are still at some risk of being guilty of a conspiracy to violate the anti-gambling laws.
