Legal Question in Construction Law in California

hoa responsibilities

I live in a condo that was converted from an apt. I have been her almost 3 yrs. I recently had a common pipe leak into my house. I had to leave my house and stay in a hotel until it dried out, my floors were pulled up and a lot of the drywall was cut off. Doesn't the HOA have to pay for all of the repairs, including my mandatory hotel stay? And how long do they have to fix the damages? It has already been 3 weeks.

I suggest that you consult an attorney for this one. Please review my profile and contact me.

If this pipe is common area owned by the HOA then you would and do have a claim for damages, including the reasonable hotel stay. I suggest that you write a demand letter to the HOA and their insurance company demanding immediate reimbursement for the lodging you are required to expend because of the damaged common pipe and demanding reimbursement for any other damages to your real and personal property. I also suggest that you file a claim against the HOA's insurance immediately.
