Legal Question in Construction Law in California

My licensed contractor gutted my bathroom 5 years ago and installed a new shower in my California condo. All work was permitted and passed inspection. The shower is now leaking into the ceiling in the condo below mine. The plumber found that this is due to a leak in the shower membrane or in the connection between the drain body and drain flange. My homeowner's insurance company denied the claim as the leak was deemed to be due to a construction defect. What is the contractor's statute of limitations for this? Is he liable 5 years later?

As long as you discovered this problem within the last 3 years, he would still be liable under the latent defect laws.
