Legal Question in Construction Law in California

Unlicensed, Fraud & Abandonment

I signed a contract with Mr. G. Mr.G, I found out does not have a contractor's license nor a Salesman's Contractor's License. Mr. G is using Mr. W's license and Mr. W knows this. Now, I have given Mr. G 35,000.00 so far out of 60,000.00. Now Mr. G and Mr. W know, that I know. Mr. W wants me to sign a new contract with him for 57,000.00. Now I have told Mr. G & Mr. W I will not sign anymore contracts and that they have money to do the job and will be paid the final amount when the job is complete. Mr. W asked for more money and so did Mr. G. Mr.W said Mr. G does not have the money. Mr. G stated the money is gone. Mr. W said he would have to loan Mr. G money from another project if I did not give him any money. Now, Mr. G goes on a 3 week vacation. None of his workers come to work. Mr. G then has his workers remove all their equipment and leave quietly. I believe I have been frauded, a possible crime committed and abandonment with the money. My house is unlivable, electrical hanging out of walls, construction debris on front yard for 5 months, plywood only on framing, windows not put in, doors not done, permits failed. I now receive a letter from Mr.W basically saying'' goodbye and good luck''. What do I do?

Re: Unlicensed, Fraud & Abandonment

File a complaint with the California State Contractor's board. Also talk with your local polic department; diversion of construction contract funds is a crime!!!

Best of luck
