Legal Question in Consumer Law in California

creditor trying to serve

Hi,

a creditor attempted to serve my wife last week. I told the person she doesn't live here anymore and I did not identify myself. The person asked if she still gets mail here and I said ''once in a while''. She still does live here and is unemployed.

What should we do?

Does the creditor have to pay for each attempted serve and is there any other way one can be served?

When we have the money we will file chap. 7 but until then its flight or flight.

Thank you,

Mark

Re: creditor trying to serve

They can serve her where she regularly gets mail, at the address on her driver's license, etc. Did they leave the papers with you? If so, she's served once they mail a copy to her at the same address.

Please let me know when you're ready to file for Chapter 7. The BK court has a filing fee waiver program if you qualify.
