Legal Question in Consumer Law in California

Spring Air Warranty Problems

I have a defective mattress made by Spring Air/Consolidated Bedding, they have deemed that it is replacable under the warranty. They state the mattress is being built in CA and I will be notified when it is complete. It has been 3 months since first trying to get this resolved. They do not return calls or emails regarding it. I have a letter stating it will be replaced. I have called several matress companies and in this amount of time thousands could have been built. Sleeping in this bed causes bad back pain as well as a bad next day due to lack of sleep. What can I do to get them to honor thier agreement?

Re: Spring Air Warranty Problems

If they are refusing to communicate with you, the only thing left for you to do is sue them for the cost of the mattress. The cost of the mattress is undoubtedly less than $7,000.00, so you can sue them in small claims court.

If item is less than $7500, take them to small claims court. Bring all documents with you on your court date.
