Legal Question in Credit and Debt Law in California

How to Cancel a Bank Levy

My bank account has had a levy attached to it related to an old credit card account. My personal bank account as well as a joint account has been attached. Is there a way to have such levy cancelled? The levy is causing financial hardship because it's preventing us from paying utilities and paying for groceries. Thank you for your help.

Re: How to Cancel a Bank Levy

If this is a Writ of Attachment you were given an opportunity to oppose it. Writs of Attachment are discretionary writs issued by the court, after a hearing on the motion to issue the writ. If it is a Writ of Execution, post judgment, then you can file a claim of exemption to have the levy limited or not enforced.
