Legal Question in Credit and Debt Law in California

I am trying to collect on the folling note.

Sept 25,2006 John Doe agrees to loan Mr and Mrs Smith 12,510.04 for two years,for closing cost at xxx Happy Ave, Somewhere Ca.xxxxx. This loan is intrest free. Term of the loan is 2 years. full payment is due in 24 months.Security for the loan,to be a deed of trust on the home at xxxHappy Ave Somewhere Ca xxxxx. And a lien on the title to the 2006 car . Sign by Mr.and Mrs Smith The Smiths are saying that because I didn't sign the note and there is no witness that the note is not valid. Of course I disagree.

Surely you didn't attempt to make a loan secured by real estate without legal assistance. They may well be right. Whether you agree or disagree with them makes no difference. Hang up from the internet and bring all your papers to a lawyer near you.

The note is enforceable if the the adverse signed. Not matter that you did not sign
