Legal Question in Credit and Debt Law in California

Collection of Debt

I received a collection notice for a Gym membership that I have not had for over 3 years. They are saying I have not paid membership dues for those years, but when I had a membership with them, my monthly dues were taken automatically from my account (same as my wife's who is still going there). I am disputing the charge, but do they have an legal right if there is no record of my cancelation except the fact that I have not been there for 3-4 years and no money was automatically deducted from my account? Do I have legal recourse against them if they persist?

Re: Collection of Debt

If this is not a valid debt and they persist, you would have a cause of action under state and federal fair debt collection laws, e.g., FDCPA. Don't give up on this and ensure that they are not reporting this to the credit agencies.

All the best,
