Legal Question in Credit and Debt Law in California

I have a friend who owes me $6,000 back in 2006. I tried collecting in 2008 via e mail and he responded that he will pay me in installments. It is 2009 now and he still has not made any attempts to pay. I have no written contract except a copy of the check and the e mail. Can that serve as a written contract? Statute of limitations on oral agreement is 2 years so does that mean I cannot get this money now? can I still go to small claims court or should I just let this go?
