Legal Question in Credit and Debt Law in California

governing state of credit card debt

Which state law applies regarding the statute of limitations on credit card debt: the state I live in (CA-4yrs), the state the credit card company's headquarter is located (S.D.-6yrs), or the state the collection agency who bought the past due account from the credit card company (CA-4yrs), or other?

Re: governing state of credit card debt

California law would apply. You need to read about the Fair Debt Collection Practices Act and the state Rosenthal Fair Debt Collection Practices Act. You can read about these at my blog, www.californiadebtblog.com. You can also request my free reports on your credit report by emailing me at [email protected].
