Legal Question in Credit and Debt Law in California

judgement lien against spouse's house

I have a renewed 12 year old judgement against a guy who has eluded payment. He and his wife bought a house in 2000 but it's in his wife's name. Since it would be community property here in California, can I lien the house?

Re: judgement lien against spouse's house

Yes, but since it is in her name, you would have to file a motion with the court to do so. Also, if the parties have a prenup that says the property is her separate property, the court probably will not let you lien it. You could also lein the wife's bank accounts.
