Legal Question in Credit and Debt Law in California

Hello Mr. Storm,

Do you know how they did it? Did you give them any kind of written electronic debit authorization? PS: Never trust collection agencies!

They have my checking account information because every month I call them to authorize them to withdraw the payment from my account. They never told me if I'm late they will automatically take it without my authorization. I never gave them written electronic debit authorization. Is there anything I can do? Is it legal?

It doesn't sound legal. You authorized one charge. Then you authorized another. Then they did another without your permission. The problem is that collection agencies are lying scum of the earth. They will probably say you verbally authorized monthly debits. You will say you did not authorize that. It's your word against theirs and if you sue them, you likely have the burden of proof. It's a case of "he said she said." Never trust a collection agency. Get everything in writing. Never give your bank account access to anyone you can't trust.
