Legal Question in Credit and Debt Law in California

Can an online cash advance company sue me and press criminal charges(fraudualent check), because I can not afford to pay it back right now? They are calling me at work everyday and threatening to send someone to my place of work and notifiy my employer. The company is based out of California. I am a South Carolina Resident.

Keep detailed logs of the date, time, and what was said. I don't know whether they can threaten criminal action in SC, but their other actions appear to violate federal debt collection laws. I'd like to hear more.
