Legal Question in Credit and Debt Law in California

tentative ruling before court tomorrow

what is the judge talking about? DENIED. There is no proof of service in the Courts file reflecting service of the instant motion. To the extent the papers

are meant to oppose the motion for summary judgment, a consideration of their merits may be made by the Court at the

hearing on the motion for summary judgment on 4/23/09.

If the tentative ruling is uncontested, it shall become the order of the court, pursuant to Rule 3.1308(a)(1), adopted by Local Rule 3.10,

effective immediately, and no formal order pursuant to Rule 3.1312 or any other notice is required, as the tentative ruling affords sufficient notice to the parties.

Re: tentative ruling before court tomorrow

It sounds like you brought a motion and the judge intends to deny it because there is no proof that you sent copies of the motion to the other side. It also sounds like the judge may or may not consider your papers in opposition to a motion for summary judgment that the other side has pending. You really need am attorney in this matter.
