Legal Question in Criminal Law in California

my 19year old son got a citation for possession of marijuana and also loitering in the los angeles river. He said he found the marijuana next to a liquor store and picked it up. My son lives with me because he was diagnosed with mental retardation, ADHD and depression. He got a citation before for smoking marijuana and it didn't go to court. He has to do a program through the american justice association. My question is: will he need a lawyer to represent him in court? Any idea what the fine would be? How do I handle this. Please help.

Don't have him plead guilty. Get a P.D. or a private lawyer. In many cases, the D.A. will agree to N.A. meetings in exchange for a dismissal. You don't want a drug conviction on his record the rest of his life if you can avoid it. Best wishes...David Wallin

I agree with Mr. Wallin. If your economic situation (income) warrants a public defender the court will grant you one. Otherwise, you should retain an experienced criminal attorney to guide you through the process as the decisions that are made now can affect him for some time to come (especially with a previous citation).
