Thank you for your inquiry on lawguru - and for the opportunity to assist you with your question.

You should at least consult with an attorney regarding your daughters situation, especially regarding the search. It's possible that, based upon the facts of the search, more than anything else, a motion to suppress may be viable in your daughters case, which may end up dismissing the case.

As a felony charge, the court will usually appoint an attorney if you can't afford an attorney, but considering the seriousness of the charges, you should begin examining all the facts of what happened in more detail, and your options, with someone experienced in criminal law.

I hope this helps, but if you have any further questions, or want or need more information, please feel free to email me directly at [email protected], anytime. Thanks again.

What can you do? Unless you are a lawyer, nothing, other than give moral support and pay for an attorney. She faces potential prison time, so I suggest you get counsel quickly. Feel free to contact me if you decide to do so.

Re: arrested for brass knuckles

Possession of brass knuckles or "metal knuckles" is a violation of Section 12020 of the California Penal Code. This could be filed as a felony or a mistomeator. As a felony she could be looking at 16 months, 2-years or 3-years in state prison. You need to have a attorney check into the facts of the case to see if the search is good. There is also need to put migating facts infront of the DA.
