Legal Question in Criminal Law in California

Somebody Else Convicted for my crime 10 yrs ago

In 1994, when I was 18 I stole about $2K from my employer, a fast food restaurant. The ensuing investigation included a polygraph, which I passed. However, another employee did not pass his polygraph and apparently confessed during the poly to my crime. He may have also confessed to stealing other small amounts of money from the till. I don't know exactly what happened, but I think he may have entered into a plea agreement for my crime and to whatever other theft he actually committed. Today, I feel horrible about what happened to him and wonder if there is anything I can do to reverse his conviction. I assume that it will be difficult due to such a small crime, age of case, and plea agreement.

If you'd like, you can have your friend's case reopened and you can offer to be charged with the crime based on new evidence. You would have to submit yourself for booking on grand theft charges and enter a guilty or no contest plea. That would subject you to the jurisdiction of the court for resititution payments and probation.

Even if you confess at this time your friend may not get the conviction set aside. It could however, result in your being convicted of a theft.
