Legal Question in Criminal Law in California

My daughter is going to prison because she defended herself from a known knock out reputation bully who has access to guns and has assaulted her in the past. My daughter was pinned down and was able to swing a sharp object to get her off but the girl was injured enough to end up in the hospital. My daughter feared her head was about to be bashed into the street. Its not fair. My daughter has a wonderful reputation as being a loving mother and helpful to society. Letters proved this.

You haven't really asked a question.

You also left out a key fact - how is it she is going to prison? Did she take a plea deal or did she go to trial and lose?

If she took a deal, then the case is over. She admitted her guilt and she will serve her sentence. If she went to trial and lost, she must file notice of appeal within 60 days of the sentence. An appeal looks at issues with how the trial was conducted, not whether or not she is a good person.

If this case is still open and she hasn't been convicted, she needs a good criminal defense attorney. I'd strongly suggest you find someone who focuses on criminal law and who routinely practices in the court where this case will be heard.
