A friend is serving 4 years for burglary and was in fire camp. He was caught with a vial of PCP in his locker. What charges could come from this and what kind of additional time is he facing. He was due to be released in 4 months.

Re: drugs in prison

With the new proposition giving drug users a second chance at rehabilitation he may simple be charged, offered drug counseling, and released on time to go to drug counseling. With the new law and his being in custody it's difficult to predict what might happen to him.

However their may be statutes making these cases more serious if they are in custody. However, I'm not aware of any.

Also his release date is usually to parole, and he has more time hanging over his head if he violates parole. Therefore his release date might be revoked. And he would serve his full sentence.
