Modified sentence

I had read a former question on modified sentencing. I too am looking for help in that area. The former question delt with DUI issues. Mine deals with spousal abuse. Can this modified sentencing form be used for all criminal cases? Or does it just pertain to a certain amount? Any information that I can get will be greatly appreciated beyond words. Getting answers to questions seems to be an endless battle. And I just don't have the money to keep paying an attorney to answer questions. I do hope that you can help me too.

You have several options:

1. Go to any court in California that has a criminal clerk and tell him/her what you need. If you're in custody go ask the guards to give you the form.

2. Write the judge a letter and put in the letter your case number and then tell him/her why you need your sentence modified.

3. If you're out of custody prepare a letter, and go to court early one morning, have the criminal clerk pull your file, and send it into the judge's court room. The judge will want the D. A. to review your reguest. The D. A. will have to pull their file or review the court's file then you speak to the judge if his/her time permits it. If time doesn't permit it then the judge should set a date to hear your request. The judge may ask you to prepare something in writing before the hearing.

The reason for the letter is that you may get nervous and forget things you want to say. The original goes to the Judge, a copy to the D. A., and a copy for you to use as your notes.
