Expungement of drug charges

I live in Ohio and had a conviction in California 16 or 17 years ago and I would like to get it expunged. This charge was possession and possession for sale (intent) of a controlled substance. What do I need to do? Do I get a lawyer in Ohio or California?

You should probably have a lawyer in California. I wouldn't know where to start if I were asked to expunge a conviction in Ohio. And there are some additional questions to discuss and resolve. Were you actually convicted of both charges? (It would be possible, but unlikely for that to happen...) Can either charge be reduced to a misdemeanor first? Can expungement really benefit you? What are you seeking to gain by expungement? While there are some real benefits to it, there are some limitations, too, and these should be discussed first. Mr. Shemaria's statement that "you can definitely get this conviction expunged" is overly optimistic. These may be crimes for which expungement is available, but whether a particular defendant will be able to have his convictions expunged will depend upon the facts of his case and upon how he has conducted himself since being convicted.

The convictions were acts of California courts and can only be reduced or expunged by California courts. The courts of Ohio have no authority to modify them in any way. You will need an attorney who is licensed in California. There are some California attorneys in Ohio, but your best bet would be to seek someone who practices close to the court where you were convicted, if only to save on travel costs.

SOME felonies can sometimes be reduced and expunged. If prison time was served or ordered, then no expungement. All probations terms must have been satisfied. It is up to the discretion of the judge, and based upon good cause as shown in the proper motions and pleadings required. Only an attorney licensed in California can do this.
