Legal Question in Criminal Law in California

False arrest

A friend was recently detained because they cops they had the right person. Turns out they were wrong. They never booked him, but searched his house and car, turning up nothing. They ripped his car seats and were unnecessarily rough with him. Does he have any recourse in getting his car seats fixed and medical bills?

Re: False arrest

Although the police have broad immunity from lawsuits, they are not permitted to use excessive force. Depending on the facts and the egregiousness of the police conduct, your friend may or may not have a case for excessive force and/or civil rights violations.
