Legal Question in Criminal Law in California

My father was a licensed home improvement salemen. He is currently in jail for burglary and grand theft. He was working on his friends residential property when he decided to go in bussiness with another man since he held the license my father would collect monthly payments from the homeowner of $50,000 they were issued to my father who would then deposit half into the buissess account and half into his account. the partner thing didnt last long and my fathers partner was no where to be found my father contacted the contractor state board and they recommended him to no longer work on this job since he did not have a contractors license. Now the homeowners filed charges. My father has receipts for materials, equipment rentals, laborer used on this job to prove all the money he deposited went right back into the property. What evidence that we have in our possession could we use in court
