Legal Question in Criminal Law in California

A guy never served me, got an order behind my back from small claims and then stole my car and disabled it. I found it at his home there’s restraining order between us. It’s him that gets arrested if if he’s around me..

My question is what happens if the police were called?

And your question is?? It should have been 'what can I do?'

If you are 'timely' you could file an appeal of the case and try to prove with credible evidence and testimony what you claim.. However, the 'guy' did not 'steal' your car, he got a court ordered judgment, sounds like one to 'repossess' it. And, since he apparently already 'executed' on his judgment, you probably are not 'timely' for a normal appeal. Suggest you hire an attorney to research this and do an appeal for you if possible, to make sure it is done right.
