Legal Question in Criminal Law in California

hit and run accidents when a person is injured

my question is if you are involved in a hit and run accident where a person is hurt. what kind of sentences are to be expected when the person is caught? and are there any loop holes to where someone involved in one, can not be held responsible if the accident was someone elses fault?

Hit and run penalties range from one year county jail to 4 years in state prison, depending the circumstances of the accident, and degree of injuries suffered by the victim.

You need to hire an attorney or request the appointment of a public defender.

Thank you for your email.

You haven't even begun to describe exactly what happened, or where, and jurisdiction is important, as different laws apply different places. As far as hit and run, that charge is contained in Vehicle Code section 20001, and states that if there is a Hit and Run causing injury or death, the penalty is 90 days county jail, 2,3 or 4 years state prison, or a fine of not less than $1000 nor more than $10,000, or by both fine and imprisonment. Note that this crime may be charged as a misdemeanor or felony.

This charge is serious and you should use an attorney to defend you against the crime. Even if the accident was the fault of someone else, if you failed to stop and exchange information, leaving the scene of an accident can subject you to penalties.

I hope that this helps, but if you have any further questions, want more information, or feel that you need do need my legal representation, please feel free to email me directly. I am happy to help in any way that I can. Best of luck.
